Amendments to the TELUS Internet Access Service Agreement
The following amendments to the Service Terms come into effect on October 25, 2009.
Section 8 of the Agreement is amended by replacing the words "at the prime rate of the Bank of Montreal plus 7%, converted to a monthly compound rate and rounded up to the nearest quarter percentage point, calculated from the due date" with the words "of 2% per month (26.82% per year), calculated from the billing date for those charges".
Sections 27 to 61 of the Agreement are renumbered as sections 28 to 62 and a new section 27 is added to the Agreement immediately after section 26, as follows:
You agree to the installation of diagnostic software on your equipment for the purposes of assisting TELUS in remotely determining the cause of any service or maintenance issue, maintaining interactive communications during a diagnostic session and sending instructions to your equipment to correct improper settings, if required. You agree that TELUS may install updated versions of the diagnostic software on your equipment without notice, for the same purposes.
Sections 37 and 38 of the Agreement as renumbered are amended by replacing the number "35" with the number "36" at each occurrence.
Section 52 of the Agreement as renumbered is amended by replacing the number "50" with the number "51".
Section 55 of the Agreement as renumbered is amended by adding the following paragraph at the beginning of the section:
Upon the expiry of the term of this Agreement, TELUS will continue to provide you the Services on a month to month basis on the terms and conditions then applicable, unless you notify TELUS at least 30 days in advance of your intention to terminate your Service or enter into a new service agreement.
Section 59 of the Agreement as renumbered is deleted and replaced with the following:
TELUS and you acknowledge and agree that: (a) the charges for, and availability of, the Services are in no way contingent or conditional on your subscription for the provision of any tariffed or tariffable service from a TELUS affiliate; (b) non-forborne telecommunications services and tariffable bundles are required to be provided, and shall only be provided, in accordance with tariffs approved by the Canadian Radio-television and Telecommunications Commission; and (c) no tariffs are applicable to the Services.
Section 60 of the Agreement as renumbered is amended by inserting "59" after the word "Section" and by replacing the number "44" with the number "45".
