TELUS TV Digital Box Subscription Terms and Conditions

Effective as of June 11, 2024

These Terms and Conditions (“Terms”) apply to your TELUS TV Digital Box (“Digital Box”) Stream+ add on subscription with TELUS Communications Inc. (“TELUS”).

1. TELUS reserves the right to amend any terms herein, including rates and additional charges, at any time by giving 30 days notice. TELUS will notify you of amendments by posting notice of the amendment at
telus.com/serviceterms
(the "Service Web Site"), or by sending you notice via email, directing to where the amendment may be consulted. If you have access to the Internet, it is your responsibility to go to the Service Web Site at least every month in order to become aware of any amendments posted on the site, and you agree to consult any amendments notified to you. You are not obliged to continue using the subscription after an amendment. However, in the event you choose not to accept the changes, your sole remedy is to cancel the subscription, in accordance with the terms herein. Your continued use of the subscription following any amendment shall be deemed to be your acceptance of the amended terms, waiver of any additional notice requirements and agreement to pay for the subscription in accordance with the amended terms.

2. Digital Box Stream+ add on subscription is available only to Stream+ Basic and Premium customers within Canada. The Digital Box includes a digital box and a bluetooth remote. If streaming on a mobile network, regular data charges apply. All rental equipment, including modem and router rental, may not be as shown in promotional images.

Minimum Requirements

Minimum systems requirements apply. You must have an active Stream+ Basic or Premium account to be eligible for the Digital Box add on. Digital Box requires an active Google account and compatible TV. Check the following requirements to ensure your equipment is compatible with the Digital Box: a. You must have an internet connection; and b. Your television needs an HDMI port to connect with the Digital Box.

HDTV input equipped-television required to watch HD. 4K HDR compatible television required to watch 4K HDR content. TELUS TV Digital Box and an Internet connection of 50mbps or above required to watch 4K HDR on the TELUS TV Digital Box. Subscription to corresponding services required.Not available with all channels, services or content. Minimum system requirements apply.

Activation

Once your request has been processed, you will receive a confirmation email from TELUS. Final eligibility for the services will be determined by a TELUS representative. The equipment will be sent to the service address provided by you in the order process.

5.
Equipment

On equipment receipt, you must verify that the equipment is complete and not damaged. You must install your equipment immediately following the provided instructions and best practices at
telus.com/selfinstall
, as applicable.

You must immediately inform TELUS of any malfunctioning of the services or of the self-installed equipment, software and/or applications.

In the event that TELUS provides support documents and/or installation guides, it is your responsibility to read them and to follow the instructions thus provided. If you perform a self-install, including a self-install of a replacement device, you assume all responsibility and risks associated with installing, configuring, using and uninstalling the equipment, software and/or applications, including the risk of any damage, loss, injury or harm that may result. Your equipment will be supported by TELUS for the duration of your rental.

You are responsible for any damage of equipment owned by TELUS, including but not limited to damage occurring during a self-install, and you shall be responsible for the retail value of said equipment.

All TELUS equipment will remain the property of TELUS and must be returned to TELUS upon termination of this Agreement for any reason.

TELUS is not responsible for the maintenance or repair of facilities or equipment owned by you, and does not guarantee that the Digital Box will operate with all television sets, remote controls, home theatre components or other audio/visual equipment. The Digital Box requires electrical power to operate, which you must supply at no charge to TELUS, and you acknowledge and accept that you may lose service during a power outage unless you supply, install and maintain at your own expense a battery backup power system.

Billing

Once you complete your order of the Digital Box, your subscription will begin and a fee of $10.00 CAD plus tax per month will be charged to the credit card (that you added to your TELUS account) every succeeding month until you cancel your TELUS TV Digital Box subscription through your online account in accordance with the “Cancellation” section below. No bill will be sent to you. Monthly charges can be viewed from your online account. Prices do not include the cost of taxes. For additional details, including on billing and changes, please refer to the TELUS Subscriptions Platform Terms of Use, which is part of agreement with TELUS.

7.
Damages

You are responsible for all use of the Digital Box, including by third parties, even if you have not authorized them to use the Digital Box. You are responsible for controlling access to your account. You will indemnify the TELUS and its affiliates, and their respective directors, officers, employees, or agents, against any claim made by a third party in connection with their use of the Digital Box.

In the event of any damage to equipment, including but not limited to damage resulting from a case of force majeure or the actions of a third party, repair or replacement shall be at your expense, in accordance with the terms and conditions and service and equipment fees in effect at the time the damage occurred.

TELUS cannot guarantee the proper functioning of the services or the equipment, software and applications self-installed. If TELUS is of the view that your self-install is not functional, successful, satisfactory, compliant or complete, TELUS may be unable to provide the applicable services.

TELUS may require that you use only the equipment provided by TELUS in connection with the subscription and it is your sole obligation and responsibility to comply with this requirement.

TELUS makes no representations with regard to any equipment not provided by TELUS or by one of its authorized representatives (“Third-Party Equipment”), which may affect the subscription ; and disclaims all liability if Third-Party Equipment is used in any way relating to the subscription.

If TELUS deems that the customer’s self-install is not functional, successful, satisfactory, compliant or complete, TELUS may decide to rectify the situation, and equipment fees may then be charged to you according to the currently applicable rates.

8.
Cancellation

You are able to cancel your subscription with TELUS at any time through your TELUS online account. Upon cancellation, your subscription will stay active until the end of your billing period. TELUS may also cancel your Digital Box add on subscription, at our sole discretion without notice to you, if we suspect any fraudulent activity, misuse of your subscription or violation of these terms or any applicable law by you. No refund will be given in case of revocation.

Upon cancellation, deactivation or suspension of service, all rental equipment must be returned to TELUS RETURNS DEPOT, TELUS COMMUNICATIONS CORP, PO BOX 22300 LCD 24, RICHMOND BC, V6X 0J1, or such other location as we may communicate to you from time to time, immediately and in good working condition with complete parts and accessories. Failure to do so within 30 business days of service cancellation will result in a charge for the full replacement cost to the account, including shipping costs. Costs associated with the return of equipment are the responsibility of the customer.

Quebec subscribers are able to cancel immediately and will receive a prorated credit.
